Software update wise. Simple option would be speak to Nintendo. If it was that then you might be able to get one, send it back to them and get one back that way.

Not sure why a bios reset won't clear it though, make sure you are doing the proper reset instructions. If there's a battery, remove battery with board unplugged for a good 5 minutes, then boot without the battery see if the cmos will be clear.
